MidStay terms of use

Welcome to MidStay! These Terms of Use (“Terms”) govern your access to and use of our website, services, and platform (collectively, the “Services”). By accessing or using MidStay, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, you may not use our Services.
1. Definitions
• “We,” “us,” “our” refer to MidStay.
• “You” or “your” refer to users of the MidStay platform, including both guests and hosts.
• “Platform” refers to the MidStay website, mobile applications, and any related services.
2. Eligibility
You must be at least 18 years old and capable of entering into legally binding contracts to use our Services. By using the platform, you represent that you meet this requirement.
3. Account Registration
MidStay, you must create an account. You agree to:
• Provide accurate, current, and complete information during registration.
• Maintain the security of your account by keeping your password confidential.
• Notify us immediately of any unauthorised use of your account.+You are responsible for all activities under your account.
4. Host terms
As a host, you agree to the following:
• You will accurately describe your property, including its features, availability, and pricing.
• You are responsible for ensuring that your property complies with all applicable local laws,
including rental regulations and safety standards.
• MidStay reserves the right to vet and approve listings. Failure to meet quality standards may
result in removal from the platform.
• You are solely responsible for setting the price of your property. MidStay will collect a
commission of 8% on each booking, as well as a 2.5% transaction processing fee.
• You must honour all confirmed bookings unless exceptional circumstances arise.
• You are responsible for providing a clean and safe environment for guests and ensuring the
property is as described in the listing.
5. Guest terms
As a guest, you agree to the following:
• You will review all property details, terms, and cancellation policies before booking.
• You must communicate with the host through the MidStay platform for all booking-related
inquiries.
• You are responsible for any damage caused to the property during your stay and may be
required to pay for such damage.
• MidStay collects a 5% booking fee from guests on top of the total booking amount.
6. Payments and fees
• MidStay uses Stripe as a payment processor. All payments are processed securely through
Stripe.
• Booking Fees: MidStay charges a booking fee of 5% to guests and a host fee of 8%, plus a 2.5% transaction fee.
• Hosts will receive payment for bookings after the guest checks in, minus applicable fees.
7. Cancellation policy
Cancellation policies are set by each host and will be clearly listed on the property page. Guests and hosts are bound by the specific cancellation policy attached to their booking. Any cancellations or refund disputes should be resolved according to the host’s policy.
8. Content and reviews
• Hosts and guests may leave reviews after each completed stay. Reviews must be honest and not contain offensive language or false information.
• By posting content (e.g., property descriptions, reviews), you grant MidStay a nonexclusive, worldwide, royalty-free license to use, modify, and distribute your content for
promotional purposes.
9. User conduct
You agree not to:
• Use the platform for any illegal or unauthorised purpose.
• Impersonate another person or misrepresent your affiliation with any person or entity.
• Use our platform to violate any local, state, or national laws or regulations.
• Interfere with or disrupt the platform, servers, or networks connected to the platform.
10. Vetting and verification
MidStay may require property inspections or video tours as part of our vetting process. Failure to comply with verification requests may result in the suspension or removal of your listing.
MidStay reserves the right to remove any listing that fails to meet our standards.
11. Insurance
MidStay recommends that hosts secure their own property insurance and that guests obtain holiday or travel insurance. MidStay does not provide insurance at this time but may offer insurance services in the future.
12. Limitation of liability
MidStay acts as an intermediary between hosts and guests. We do not own, manage, or control
properties listed on our platform. As such, we are not liable for:
• Any personal injury or property damage arising from a stay.
• The behaviour or actions of hosts or guests.
• The accuracy of property listings.
MidStay’s total liability is limited to the amount of fees paid to us by the user in the six months
preceding the event giving rise to the claim.
13. Dispute resolution
In the event of a dispute between a host and a guest, we encourage open communication through our messaging platform. If a resolution cannot be reached, MidStay may intervene, but we are not obligated to mediate disputes.
14. Modifications to the service
We reserve the right to modify or discontinue our platform or any service at any time, without
notice. MidStay is not liable to users or third parties for any modifications, suspension, or
discontinuation of our services.
15. Privacy policy
Your use of MidStay is also governed by our Privacy Policy, which outlines how we collect, use,
and protect your personal information. By using our platform, you agree to the terms of our Privacy Policy.
16. Termination
MidStay reserves the right to suspend or terminate your account and access to the platform at our discretion, without prior notice, if you breach these Terms or engage in unlawful activity.
17. Governing law
These Terms are governed by the laws of [Your Country/State], without regard to conflict of law
principles. Any legal action related to these Terms or the use of our platform must be brought in a court of competent jurisdiction located in [Jurisdiction].
